What are Mass Tort Cases?

Many people are familiar with the term class action but are less familiar with the term mass tort. Mass tort actions are similar to class actions in that the cases are often consolidated and handled by a single court. The cases usually revolve around the same defendant and that defendant’s product.

Round Up

Talcum Powder

Johnson & Johnson has seen more than 9,000 lawsuits from individuals claiming the regular use of baby powder in the female genital region contributed to ovarian cancer. This is because of trace amounts of asbestos found in the product.

The International Agency for Research on Cancer, which is a well-respected agency within the World Health Organization, found an “unusually consisted” increased chance of women developing ovarian cancer if they used the Johnson & Johnson talcum powder in their genital area on a regular basis. 

Evidence presented during a Missouri case showed that Johnson & Johnson officials were aware for over 30 years that their talcum powder contained asbestos, but failed to do anything about it.

Defective Hip Implants

When someone decides they need a hip replacement, they have already suffered through tremendous amounts of pain. Committing to the procedure involves a major surgery and a lengthy recovery time. So when the procedure fails, it can be extremely frustrating as well as painful.

Styker and DePuy issued two of the most notable hip implant recalls. Styker issued a voluntary recall for their ABG II and Rejuvenate hip implants. Evidence proved the metal-on-metal design resulted in bone and tissue damage that caused adverse local tissue reactions.

In 2010, DePuy recalled their Articular Surface Replacement (ASR) Hip Resurfacing System and ASR Acetabular hip system for similar reasons. Researched showed the metal-on-metal hip implants had a failure rate of 40% compared to the standard rate of less than 10%.

Over time, the metal from the implant would rub together during everyday movements. In turn, this cased the metal to corrode and metallic debris was produced and deposited in the implant site. This caused patients to experiences symptoms such as: 

  • Inflammation
  • Infection
  • Tissue and bone damage
  • Pseudotumors
  • Metallosis

Hernia Mesh

When someone undergoes surgery for a hernia, the surgeon is likely to use a synthetic like material called polypropylene to patch the weakened area. Hernias can be extremely painful. They are rarely life threatening, but it will not go away on its own without treatment.
