DOG NEVER BITTEN BEFORE

If the animal that bit or attacked has never bitten before, the law first looks at the severity of the injury. A severe injury is "any physical injury that results in broken bones or disfiguring lacerations requiring multiple sutures or cosmetic surgery." Sec. 102. All other injuries are classified as non-severe.

A severely injured victim can make a Dog Law claim against the dog owner for pain and suffering, medical expenses, future medical expenses, lost wages, etc. The victim must prove the Defendant was the owner of the dog and that the dog was not provoked in any manner. Whether the dog bit anyone on a prior occasion does not matter.
